4. Purchasing Process

The purchasing process consists of selecting products, adding them to the basket and confirming the order following payment.

The customer will receive an email confirmation with the order details.

Shipping costs, where applicable, will be shown separately and clearly identified before the purchasing process is completed.

4.1 Availability and Viability of Animals

All orders are subject to actual stock availability and, where they include live animals, to verification of the animals' condition and viability before dispatch.

Owing to the nature of live animals, Antomas may postpone dispatch where there are circumstances that could compromise their health, safety or viability, including:

  • - Health or developmental problems of the animal.
  • - Biological issues.
  • - Stock errors.
  • - Adverse weather conditions.
  • - Logistical or transport restrictions.
  • - Public holidays or service interruptions.
  • - Any other reasonable circumstance that could compromise the animal's welfare.

Where dispatch needs to be postponed, the customer will be informed and a new date will be proposed.

If a product cannot be supplied, the customer may choose to:

  • - Wait until the product is available again.
  • - Voluntarily accept an equivalent substitute.
  • - Receive a refund for the unavailable product.
  • - Voluntarily accept a store voucher.

A substitute product or a voucher will not be imposed without the customer's agreement.

    5. Prices

All prices are stated in euros (€) and include applicable taxes (VAT).

Prices may be changed at any time; the prices in force at the time of purchase will always apply.

    6. Payment Methods

    Available payment methods may include:

    • Visa card
    • Mastercard card
    • Bank transfer
    • PayPal

Card payments are processed through the Getnet secure payment gateway. Antomas does not receive or store the full details of the card used by the customer.

Orders will be processed once payment has been confirmed. For bank transfers, processing of the order will begin once the funds have actually been received.

Transactions carried out through external platforms (such as PayPal) are subject to those platforms' own security and usage terms.

    7. Shipping, Costs and Delivery Times

    7.1 Dispatch Days

Orders containing live animals are generally dispatched from Monday to Wednesday, in order to reduce the risk of parcels being held up over weekends or public holidays.

In weeks with public holidays, extreme temperatures or logistical issues, dispatch may be postponed. In such cases, the customer will be informed.

    7.2 Shipping Costs

Shipping costs depend on the destination, weight, carrier, selected delivery option and packaging requirements.

    Indicative rates are as follows:

    • - Mainland Spain: from €9.99.
    • - Balearic Islands: from €9.
    • - Canary Islands, Ceuta and Melilla: €24.99. Orders are invoiced without Spanish VAT. Import taxes (IGIC in the Canary Islands, IPSI in Ceuta and Melilla) and customs clearance fees are paid by the customer to the carrier on delivery.
    • - France, Germany, Belgium, Italy, the Netherlands and Portugal: from €24.99.
    • - Rest of the European Union and other European countries: from €27.99.
    • - United Kingdom: from €18.99.

The final amount will be shown separately during the purchasing process and before the order is confirmed and paid for.

Where special packaging or thermal measures are required, their cost will be shown at checkout or will be communicated to, and expressly accepted by, the customer before the order is shipped.

    7.3 Delivery Times

Once the order has been dispatched, the usual transit times are:

    • - Mainland Spain: approximately 1 working day.
    • - European Union: approximately 1 to 3 working days.
    • - United Kingdom and other international destinations: approximately 4 to 7 working days, excluding any possible customs delays.

The transit time begins when the order is dispatched and not necessarily on the date of purchase.

The times stated are estimates and may be affected by public holidays, customs, carrier issues, weather conditions or events of force majeure.

Unless a later date is expressly agreed for weather-related, biological or logistical reasons, the order will be delivered within the applicable statutory period.

    8. Specific Terms for Live Animals

The animals offered are living beings and may show natural variations in:

    • Size
    • Colouring
    • Pattern
    • Behaviour
    • Activity level
    • Development, growth or progression

Such variations shall not be regarded as a lack of conformity or as a product defect.

Images, videos and descriptions are for guidance only and do not constitute an exact or guaranteed representation of the specimen received.

The customer acknowledges that, owing to the biological nature of the product, there may be reasonable differences between the specimens shown and those delivered.

    8.2 Conditions After Delivery

Antomas guarantees that the product corresponds to what was ordered and will be liable for any issues, order preparation errors or lack of conformity existing at the time of delivery, in accordance with the applicable legislation.

Once the live animal has been delivered in good condition, Antomas cannot guarantee:

    • - Its adaptation to unsuitable set-ups.
    • - Its reproduction or future behaviour.
    • - Compatibility with other specimens.
    • - Its survival in the event of errors in temperature, humidity, feeding, ventilation or handling.
    • - Any particular development, size or growth rate.

These limitations apply only to circumstances arising after delivery that are attributable to the customer's care, set-up or handling, and do not remove any statutory rights the customer may have in respect of problems existing before receipt.

    8.3 Seller's Technical Judgement

The seller reserves the right to determine, on the basis of technical and animal welfare criteria, the optimal shipping, packaging and handling conditions.

Such criteria shall prevail over any logistical preference or request made by the customer where the animal's wellbeing is at stake.

    9. Weather Conditions and Special Packaging

In order to protect the animals during transport, certain orders may require:

    • - Heat pack.
    • - Ice pack.
    • - Insulated packaging.
    • - Other thermal or physical protection items.

Where any of these items is mandatory, its cost will be shown during the purchasing process or communicated to the customer in order to obtain their express acceptance before dispatch.

Antomas will not unilaterally add any costs that have not been previously disclosed and accepted.

Where weather conditions pose a significant risk, Antomas may postpone dispatch and inform the customer of a suitable new date.

If it is not possible to ship the order within a reasonable period, the customer may accept a new date or request cancellation and a refund for the affected product.

    10. Receipt of the Order and Claims

To ensure that any issues are handled properly:

    10.1 Recommended Procedure

To facilitate the handling of any issues, the customer is advised to record a continuous video (without cuts) upon receipt of the order, showing:

    • All sides of the parcel before opening it
    • The entire unpacking process
    • The condition of the contents after opening

    10.2 Claims and Issues

Claims relating to transport damage or DOA (Dead On Arrival, i.e. the specimen arriving dead) must be reported as soon as possible after receipt of the order, accompanied by sufficient evidence of the issue.

The absence of an unpacking video may hinder or limit the assessment of issues relating to transport or DOA.

Where the issue is validated, the seller may choose between:

    • Replacement of the specimen
    • Store voucher
    • Partial or full refund

    11. Returns and Right of Withdrawal

11.1 How to Request a Return

To request a return, report an issue or exercise the right of withdrawal where applicable, the customer must contact Antomas through one of the following channels:

    The request must include:

    • Customer's name.
    • Order number or reference.
    • Product or animal concerned.
    • Reason for the request.
    • Photographs, videos or other evidence of the issue, where applicable.

Antomas will reply with instructions and, where appropriate, the address to which the product should be sent.

The customer must adequately protect the product during transport and must not return it until the relevant instructions have been received.

    11.2 Non-Living Products

As a general rule, consumers have a period of 14 calendar days from receipt of the order to withdraw from the purchase of non-living products, without having to give any reason.

To exercise this right, the consumer must inform Antomas of their decision by means of a clear statement and return the product within 14 calendar days of that notification.

The direct costs of returning the goods shall be borne by the customer where the withdrawal is not due to a defect, damage, an order error or a lack of conformity attributable to Antomas.

The customer may examine the product in the same way as they reasonably could in a physical shop. They will only be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

Wherever reasonably possible, the product should be returned with its accessories and original packaging, properly protected. The absence of the original packaging will not automatically prevent the right of withdrawal from being exercised.

11.3 Live Animals and Perishable Biological Products

The right of withdrawal shall not apply where, owing to the nature and specific circumstances of the product, it is liable to deteriorate, lose viability or expire rapidly.

This exception may apply, among others, to:

    • Live animals.
    • Perishable foodstuffs.
    • Live cultures.
    • Other biological products whose return could compromise their survival, welfare, health status or viability.

The exclusion of the right of withdrawal does not limit the customer's rights where the animal or product arrives dead or damaged, is incorrect or shows a lack of conformity attributable to Antomas.

11.4 Defective, Damaged or Incorrect Products

Where the return is due to a defective product, an error in preparing the order, damage occurring before delivery or a lack of conformity attributable to Antomas, the customer shall not bear the costs necessary to provide the appropriate remedy.

Depending on the circumstances and the applicable legislation, the remedy may consist of:

    • Replacement of the product or specimen.
    • Full or partial refund.
    • Proportionate price reduction.
    • Store voucher, only where the customer voluntarily accepts it.

    11.5 Refunds

Where the right of withdrawal applies, Antomas will refund the payments received for the products concerned, including, where legally required, the costs of the standard delivery method offered.

Any additional costs resulting from the customer having voluntarily chosen a delivery method more expensive than the least expensive standard delivery method offered by Antomas will not be refunded.

The refund will be made using the same payment method used by the customer, unless both parties expressly agree on another method that does not incur any additional costs for the consumer.

Antomas may withhold the refund until it has received the products back or until the customer has supplied sufficient evidence of having sent them back, whichever is the earlier.

    12. Liability

Antomas shall be responsible for correctly preparing the order and for delivering products that conform to what was ordered.

Antomas shall not be liable for any damage or problems occurring after delivery where these are the direct result of:

    • Unsuitable set-ups or care conditions.
    • Errors in temperature, humidity, ventilation, lighting or feeding.
    • Incorrect handling of the animals or products.
    • Mixing with incompatible species or specimens.
    • Release, escape or abandonment of the animals.
    • Failure to follow the essential care instructions provided.
    • Actions of the customer or of third parties unrelated to Antomas

Reasonable natural variations in size, colouring, pattern, activity, behaviour or stage of development shall not in themselves constitute a lack of conformity, provided that the product or specimen substantially corresponds to what was ordered.

Nothing in these terms and conditions shall exclude or limit the mandatory statutory rights of the consumer in respect of order errors, lack of conformity, damage occurring before delivery or breaches attributable to Antomas.

    13. Responsible Keeping of Animals

    The customer undertakes to:

    • Provide the animals with suitable set-ups and care conditions.
    • Find out about the essential needs of the species purchased.
    • Take reasonable measures to prevent escapes.
    • Not abandon or release specimens into the wild.
    • Not use the animals for unlawful activities.
    • Comply with the legislation applicable to the keeping, transport and care of the species in their place of residence.

    14. Intellectual Property

All content on the website, including images, photographs, videos, texts, logos, designs and graphic material, is protected by intellectual and industrial property rights.

Its reproduction, distribution, public communication, transformation or use without the express authorisation of the website owner is prohibited.

    15. Force Majeure

The seller shall not be liable for any failure or delay in performing its obligations where this is due to force majeure or circumstances beyond its control, including, among others:

    • Weather events
    • Logistical or transport problems
    • Administrative restrictions
    • Epidemics or public health incidents
    • Interruptions to services or supplies

Where a force majeure event temporarily delays performance, the affected obligations shall be suspended for the time strictly necessary.

If the situation permanently prevents delivery or causes a delay that the customer does not wish to accept, the customer may request cancellation of the affected order and the corresponding refund.

    16. Data Protection

Personal data will be processed in accordance with the applicable legislation (RGPD – the EU General Data Protection Regulation, GDPR – and LOPDGDD, the Spanish Organic Law on Data Protection and Guarantee of Digital Rights).

For further information, please see the Privacy Policy.

    17. Governing Law and Jurisdiction

These terms and conditions are governed by Spanish law.

In the event of a dispute concerning consumer matters, the Courts and Tribunals of the consumer's place of residence shall have jurisdiction.
